Mediation

Mediation is a process by which couples who have decided to separate or to divorce attempt, with the help of a Mediator, to agree upon the issues arising from their separation or the dissolution of their marriage, in a more informal and cost effective way - without litigating through solicitors or the Court.

It is intended that Mediation will assist parties to negotiate their own terms of settlement on issues such as property, finance and children.

Each party is free to consult with their legal representatives either before engaging in Mediation, or at different stages throughout the process. Any agreement reached at Mediation can then be incorporated into a Court Order.

Public Funding (Legal Aid) is available to those who attend Mediation. Importantly, and unlike some other types of public funding, assistance with the cost of Mediation does not have to be repaid to the Legal Services Commission.
